Terms of Service
These terms are an agreement between you and Shannon Walters ("jomo", "we", "us") for the jomo app and website. By creating an account or using jomo, you agree to them. If you accept them for a childcare center, you confirm you're allowed to do so for the center. If you downloaded jomo from the App Store, Apple's Standard Licensed Application End User License Agreement also applies to the app.
Your account
You must be an adult to use jomo. Accounts exist inside a center: you join when a center invites you or accepts your application. Give accurate information, keep your sign-in details private, and tell your center or us straight away if you think someone else is using your account. You're responsible for what happens under it.
Centers and care
jomo is a tool that centers use; it doesn't provide childcare or make care decisions. Each center is responsible for its staff, for the information it records, for its own policies (including permission to photograph children) and for its legal obligations.
jomo isn't an emergency service, and notifications can be delayed. In an emergency, call 911 or your local emergency number, and contact the center directly about anything urgent.
What you share
You keep ownership of the messages, photos and other content you add. You allow jomo to store, show and send that content only to operate jomo for you and your center. Share only what you have the right to share, and share information about children only as your center's policies and their guardians allow.
Acceptable use
jomo has no tolerance for objectionable content or abusive users. Don't post or send anything that is abusive, harassing, hateful, sexual, violent, misleading or illegal; don't share a child's information outside their center; and don't try to get into other accounts, copy or reverse-engineer jomo, or disrupt it.
To report content or a user, tell your center or email hello@jomo.kids. We act on reports within 24 hours, which can mean removing content and suspending or closing the account responsible. Centers can also remove people and content from their own center.
Payments
jomo is free for families and staff to download and use. Fees for childcare are set by each center. Invoices are between your family and the center: payments are processed by Stripe and paid to the center, under Stripe's terms. Ask the center about refunds and billing disputes. A center's own jomo plan is covered by a separate agreement with the center.
Changes, availability and ending
We improve jomo over time, and features can change or end. We work to keep jomo available but can't promise it will always be uninterrupted or error-free.
You can stop using jomo at any time and delete your account in the app. A center can remove you from the center. We can suspend or close an account that breaks these terms or puts others at risk. The sections on content, disclaimers, liability and governing law continue after an account ends.
Disclaimers and liability
jomo is provided "as is" and "as available". To the extent the law allows, we make no warranties beyond those in these terms, and we aren't liable for indirect, incidental, special or consequential losses, or for lost data, profits or revenue. Our total liability for any claim about jomo is limited to the greater of the amount you paid us in the 12 months before the claim and US $100. Nothing in these terms limits liability that can't be limited by law.
Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Disputes will be heard in the state or federal courts located in California, unless the law where you live gives you the right to bring them there.
Changes to these terms
When these terms change, we'll post the new version here with a new effective date. If a change is significant, we'll tell you in the app or by email before it takes effect. Using jomo after that means you accept the new terms.
